While outside counsel and clients often pause during the course of a legal matter to think about winning discrete issues or winning the trial, if and when one occurs, many do not formulate a detailed strategic plan at the beginning of the case to accomplish defined goals and objectives. Attorneys may hesitate to spend the client’s money at the beginning of a case to form a plan when the relationship may be new, and instead want to show the client that they will provide aggressive representation. Clients can let the practical reality of legal budgets be a driving factor in initial planning and often start a matter by demanding from outside counsel a detailed budget before anyone understands what is involved and what the ultimate objective will be. This is akin to asking a home builder for a detailed budget before anyone has given serious thought about what the house should look like. Because planning is so important, clients should demand a strategic plan early in a matter and commit to an initial budget for the investigation and planning needed to form that plan.
